3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.

4. User Content

Our services allow you to create QR codes that link to content you provide or specify. You are solely responsible for the content you link to through our QR codes, and you represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all intellectual property rights in and to any content linked through QR codes.
  • Your content does not violate any third-party rights, including intellectual property rights and privacy rights.
  • Your content complies with these Terms of Service and all applicable laws and regulations.

5. Prohibited Uses

You may use our services only for lawful purposes and in accordance with these Terms of Service. You agree not to use our services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate QR Experiences, a QR Experiences employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our services, or which may harm QR Experiences or users of our services.
  • To generate QR codes that link to content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

6. API Usage

If you use our API, you agree to:

  • Comply with any rate limits and other API usage guidelines we provide.
  • Not attempt to circumvent or exceed API usage limitations.
  • Keep your API keys secure and not share them with unauthorized parties.
  • Properly attribute QR Experiences as the source of QR code generation when using our API in your applications.

7. Payment Terms

We offer both free and paid subscription plans. By selecting a paid subscription, you agree to pay all fees in accordance with the billing terms in effect at the time.

Payments are non-refundable except as required by law or as explicitly stated in these Terms. You are responsible for all applicable taxes.

We may change our fees at any time. If we change our fees, we will provide notice of the change on the website or by email, at our option, at least 14 days before the change takes effect.

8. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms of Service.

Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.

9. Limitation of Liability

In no event shall QR Experiences, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use our services.
  • Any conduct or content of any third party on our services.
  • Any content obtained from our services.
  • Unauthorized access, use, or alteration of your transmissions or content.

10. Disclaimer

Our services are provided on an "as is" and "as available" basis. QR Experiences makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Governing Law
